Stow to Sue Woman Over Taser Settlement

City plans to claim breach of contract in $100,000 settlement

The city of Stow is planning to sue an Akron woman for breach of contract over a $100,000 court settlement that stemmed from allegations of police misconduct. Stow Law Director Brian Reali told members of Stow City Council Monday that the city plans to file a lawsuit against Chelsea Garrett, the 23-year-old who sued the city after being tased by Stow police in November 2011. In January, Stow's insurance carrier agreed to settle the lawsuit for $100,000. But Reali said that Garrett violated that settlement agreement. "Part of the settlement was a non-disclosure agreement," he said. "Within a day of signing that contract she went to media outlets ... and made statements in violation of that agreement. Stow May Sue Over Taser Settlement News Report

City officials say plaintiff may have breached disclosure agreement

The fall-out over a court case involving alleged misconduct by the Stow Police Department is not over yet. Stow city officials this week issued a statement disputing the accuracy of a recent news segment about a 23-year-old Akron woman who sued the city after being tased by Stow police in November 2011. Stow Mayor Sara Drew and Stow Law Director Brian Reali reacted to the news report during Thursday's Stow City Council meeting regarding the $100,000 settlement reached in the case with the plaintiff, Chelsea Garrett. Reali called the news segment, a report by a Cleveland TV station, "completely false." Woman Tased by Stow Police Awarded $100,000 Settlement

Stow officials deny Chelsea Garrett's public statements that she was a victim of police brutality.

On Wednesday, Stow Mayor Sara Drew issued a statement disputing the accuracy of a recent news segment about a 23-year-old Akron woman who sued the city after being tased by Stow police. In the news report, released earlier this week by a local media outlet, Chelsea Garrett said she was the victim of police brutality when officers tased, handcuffed and arrested her after she almost clipped a police cruiser while driving. With her lawyer present during the TV interview, Garrett argued she was suffering from diabetic blackouts at the time of the Nov. 2011 incident, which caused erratic driving and inhibited her from following police commands.  The city presented a different version of the events in its press release: "The day Ms. Garrett was …

Stow and Woman Tasered by Police Fail to Reach Agreement in Federal Lawsuit

The 23-year-old Akron woman who filed a Federal lawsuit against the city of Stow seeking $250,000 in damages rejected Stow's offer to settle for $10,000 May 8, according to a Fox 8 News Cleveland story.  The Akron woman, Chelsea Garrett, who was Tasered in November by Stow Police Officer Jesse Reedy, who was cleared for his use of force by a committee, filed the Federal lawsuit claiming police brutality in March.  On Nov. 5, Garrett was charged with reckless operation, a minor-misdemeanor, and obstruction official business, a second-degree misdemeanor by Stow and charged with a DUI in Akron for bouncing off a median wall on S.R. 8, hitting a vehicle in Akron and leaving the scene of the accident. An Akron woman who was Tasered in November by Stow Police Officer Jesse Reedy, who was cleared for his use of force by a committee, has filed a Federal lawsuit claiming police brutality.  On Nov. 5, Chelsea Garrett, 23, was charged with reckless operation, a minor-misdemeanor, and obstruction official business, a second-degree misdemeanor by Stow and charged with a DUI in Akron for bouncing off a median wall on S.R. 8, hitting a vehicle in Akron and leaving the scene of the accident. A 90-pound Akron woman claimed police brutality after being shocked with an electric stun gun by Stow Police Officer Jesse Reedy Nov. 5 — but the Use of Force Committee found the officer was within policy guidelines.
